Canada Stream TV – Terms of Service

1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern your access to and use of the software application and services provided by Canada Stream TV (“Canada Stream TV,” “we,” “us,” or “our”). By accessing, installing, or using the Service, you confirm that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, you must not use the Service.

2. Eligibility and User Responsibility

You must be of legal age in your jurisdiction to access or use the Service. Where permitted by law, minors may only use the Service with the express consent and supervision of a parent or legal guardian, who assumes full responsibility for the minor’s use of the Service.

You are solely responsible for:

  • obtaining and maintaining Internet access and compatible devices;
  • all activity conducted through your account; and
  • ensuring your use of the Service complies with applicable laws and regulations.

Canada Stream TV has no responsibility for your Internet service provider, device performance, or network restrictions.

3. Description of the Service

Canada Stream TV provides a technology platform that indexes and organizes publicly available third-party streaming sources accessible on the internet. Canada Stream TV does not host, upload, store, transmit, rebroadcast, or control any media content.

All content accessed through the Service originates from third parties and remains the sole responsibility of those third parties. Canada Stream TV exercises no editorial control over such content and makes no representations regarding its legality, accuracy, availability, or quality.

4. Subscription, Payments, and Billing

Access to the Service requires an active subscription.

You acknowledge and agree that:

  • all prices are subject to change without notice;
  • cryptocurrency payments are non-refundable and irreversible once confirmed on the blockchain – please refer to our Refund Policy;
  • chargebacks, payment reversals, or fraudulent payment activity may result in immediate suspension or termination of service; and
  • you are responsible for any applicable taxes, fees, or exchange rate differences.

Refunds, if any, are governed strictly by our published Refund Policy.

5. Licence Grant

Canada Stream TV grants you a limited, non-exclusive, non-transferable, revocable licence to install and use the application solely for personal, non-commercial use during the term of your active subscription.

This licence becomes effective upon installation and acceptance of these Terms and terminates automatically upon subscription expiry, termination, or uninstallation of the application. Canada Stream TV reserves the right to suspend, modify, or discontinue the Service, in whole or in part, at any time, without notice or compensation.

6. Intellectual Property

All software, branding, trademarks, logos, and platform components associated with Canada Stream TV are the exclusive property of Canada Stream TV or its licensors.

The Service may provide access to third-party content not owned or controlled by Canada Stream TV. Canada Stream TV does not claim ownership of such content and assumes no responsibility for any infringement of intellectual property or other rights arising from third-party materials. Any copyright or takedown requests must be directed to the original content source.

Nothing in these Terms grants you any ownership or proprietary rights in the Service or any third-party content.

7. Prohibited Use

You agree not to:

  • use the Service for unlawful purposes;
  • attempt to interfere with, reverse engineer, or bypass Service security or access controls;
  • resell, redistribute, or commercially exploit the Service without authorization; or
  • provide false or misleading information to Canada Stream TV.

Violation of this section may result in immediate termination without refund.

8. Disclaimer and Limitation of Liability

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted under applicable Canadian law, Canada Stream TV disclaims all warranties, representations, and conditions, whether express, implied, or statutory, including but not limited to merchantability, fitness for a particular purpose, accuracy, non-infringement, availability, and uninterrupted operation.

Canada Stream TV does not guarantee that the Service will be error-free, secure, uninterrupted, or compatible with all devices or applications.

To the maximum extent permitted by law, Canada Stream TV, its owners, directors, officers, employees, contractors, affiliates, and agents shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of profits, loss of data, loss of service, device damage, business interruption, or legal exposure, arising from or related to:

  • your use of or inability to use the Service;
  • third-party content or applications;
  • ISP restrictions, throttling, or blocking;
  • malware, viruses, or security breaches originating from third parties; or
  • enforcement actions or claims related to content accessed through the Service.

Where liability cannot be excluded, the total aggregate liability of Canada Stream TV shall not exceed the lesser of CAD $10 or the amount paid by you to Canada Stream TV in the 30 days preceding the event giving rise to the claim.

9. Indemnification

You agree to defend, indemnify, and hold harmless Canada Stream TV and its owners, directors, officers, employees, contractors, affiliates, and agents from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including legal fees on a solicitor-client basis) arising out of or related to:

  • your use or misuse of the Service;
  • your violation of these Terms;
  • your violation of any applicable law or regulation; or
  • your access to or use of third-party content.

This indemnification obligation survives termination of these Terms.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. You irrevocably submit to the exclusive jurisdiction of the courts located in British Columbia for any dispute arising out of or relating to these Terms or the Service.

11. Amendments

Canada Stream TV reserves the right to modify or replace these Terms at any time without prior notice. Continued use of the Service following any changes constitutes acceptance of the revised Terms.

12. Severability and Survival

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Sections relating to limitation of liability, indemnification, intellectual property, and governing law shall survive termination.
